How We Collect Information
We have relationships with third parties, including automobile manufacturers, dealers, independent workshops and other businesses that deal with inspections (“Business Customers”) and we offer a variety of services and products, including Software as a Service applications (“SaaS Software as a Service ”) and mobile applications (“ Business Services ”) (collectively,“ Products ”).
As described below, our Business Clients enter consumer information into our Products about their individual clients, as well as prospects (“Consumers”) through the use of the Business Services. For example, a business customer may enter the consumer's name and email address into our Products to enable email communication with the consumer via our Products. Consumer information is only collected if a Business Customer makes the decision to manually enter it into our Products or if the business customer wishes to integrate third-party software containing consumer information with our Products.
The type of consumer information we collect depends on how a Business Customer interacts with our Products, and may include, without limitation, contact information, such as the consumer's name, address, email, mobile phone, and vehicle information. consumer, such as make, model and year.
ClearMechanic only accesses or uses consumer information for the purpose of providing Business Services, resolving or preventing technical problems, for support issues, or if required by law. For example, a Business Customer may store contact details such as the name, mobile phone along with information about your particular vehicle within our Products.
Likewise, Clearmechanic provides a service to Business Clients that consists of telephone calls between the Business Client's staff and the Consumer for quality purposes ("ClickToCall"). These telephone calls are recorded for quality monitoring purposes. service and Clearmechanic reviews and provides feedback to their service centers for joint improvement. It is important to mention that in these calls, only the data established in this privacy notice for Consumers will be requested, and the main purpose of the telephone call is only to evaluate the quality of Business Clients.
It is important to inform you that telephone calls are recorded by an external server that provides telephony through IP, so in this Privacy Notice, we inform you that calls are stored on said server, and when the Client requests a recording, is downloaded from the server, which operates as a "cloud" on the network, and we proceed to carry out the evaluations corresponding to the ClickToCall program.
From our Business Clients
ClearMechanic also collects, transfers and uses information from current Business Customers, as well as prospects for the purposes of sales, billing, marketing and recruiting processes. We collect Business Customer information from our Business Customer's staff through the use of the Business Service. For example, we maintain databases including name, email, company name, job title, and phone number about our point of contact for each Business Client. In this context, ClearMechanic acts as a data controller. ClearMechanic only uses information about the Business Customer for the purposes of sales, marketing or to administer the Business Services.
CMI may also collect personal data from Business Clients to develop ClickToCall's main Object, since it is the subject to be evaluated in the telephone recordings.
From third parties
ClearMechanic may also obtain information about consumers or Business Customers from affiliated third parties, or associated companies, and from advertising or marketing companies that provide us with information as part of their relationship with us. We may combine this with information that has already been collected to offer the Business Service and that may be of interest to our Business Customers.
How We Share and Disclose Your Information
Within ClearMechanic, we may share information and telephone recordings from the ClickToCall program about Consumers or Business Clients with ClearMechanic employees, agents, contractors who have a legitimate business reason for obtaining access to such information. We may also share information about Consumers or Business Clients with our Business Clients who have a legitimate business reason to obtain access to said information. However, we will not sell such information to unaffiliated third parties for their own marketing purposes. (example, for topics unrelated to ClearMechanic's business).
Information that we collect from, or obtain from, Consumers, Business Clients, is considered a business asset. If we are acquired, or we merge with another entity, and if all or part of the assets are acquired, or in response to a bankruptcy proceeding, We may transfer Your information to another entity.
In accordance with the ClickToCall service, we may transfer the telephone recording, including the personal data contained therein, with any CMI Client that requests it, which must have a business reason with respect to said call, that is, to be of the Brand or Production Plant related to the Business Client. Likewise, the calls are transferred with the IP telephony servers contracted by the company, a company that has entered into a confidentiality agreement with CMI regarding this ClickToCall service.
The business customer, by virtue of the ClickToCall service, is empowered to record consumer calls for quality and service purposes. In the same way, the Business Client will have the obligation to establish the foregoing in their policies and privacy notices, in order for the consumer to authorize the transmission and recording of the call.
Tracking Technology Used by ClearMechanic
Like many service providers, we use mechanisms to track information about the use of our Sites and Services.
We may collect one or more identifiers for any particular device that you use to access the internet (each has a "Device Identifier"). When utilization is analyzed, such information helps us determine how our Sites and Services are used, and we can also find the most relevant features. We may associate your Device Identifier with other information that we have collected or obtained about Consumers or Business Customers.
Information Related to the Use of the Services
Our servers automatically record certain information about how a person uses our Services (we refer to this information as "Log Data"). Log Data may include information such as the Internet Protocol (IP address), browser type, operating system, Web page that an individual previously visited when accessing our Sites and Services, pages or features of our Sites and Services to which a user browsed, time spent on those pages or features, search terms, links on our Sites and Services that a user clicked on, and other statistics. We use Log Data to administer the Services and we analyze (and may contract with third parties to analyze) Log Data to improve, personalize and improve our Services by expanding the features and functionalities by modifying them to the needs and preferences of our users. We may use a person's IP address to combat spam, malware, and identity theft. We also use the IP address to generate aggregate, non-identifiable information about how our General Services are being used.
ClearMechanic uses a variety of third-party services to help us understand the use of our Sites and Services (eg, Google Analytics). Service Providers that are third parties may collect information sent by your browser, such as cookies or your IP address. For example, the information generated by a cookie and other technology platforms about your use of our Services (including your IP address) may be transmitted and stored by Google. In this case, Google will use this information for the purpose of evaluating your use of our Sites and Services, generating reports of activity on the web and internet use. Google may transfer this information to third parties when required by law, or when a third party processes the information on behalf of Google.
Access and Opt-Out Option
You can review and update the information we have about you by writing to ClearMechanic at email@example.com. We will take the necessary steps to erase your information as quickly and conveniently as possible, but some of your information may remain in file / backup copies of our records in case they are required by law.
Please note that certain communications required by Law and transactions will not be affected by the choices you have made.
If You choose not to receive ClearMechanic emails or newsletters, You can: (i) opt out or unsubscribe by emailing us at firstname.lastname@example.org or (ii) following the opt-out instructions in the emails or newsletters.
As the owner of the personal data provided to "CMI", you have the right to access, rectify, cancel or oppose your respective data, for this "CMI" as the person in charge, will provide you upon request by email email@example.com, an ARCO rights request, which you must fill out with your data and specify what right you want to exercise and what data you intend to access, rectify, cancel or oppose. Likewise, you must specify that you are identifying yourself as the owner or proxy of the owner. If we receive information about Consumers or Business Customers who are located outside the United States, we may transfer that information to the United States and process it there.
We take administrative, physical and electronic measures designed to protect the information that we collect or obtain from Consumers, Business Customers with unauthorized access, use or disclosure. Please be careful however, that there is no completely secure method when transmitting or storing information over the internet. Therefore, we cannot guarantee absolute security of any information. We will make any legal requirement regarding security, confidentiality or integrity of your “personal information” that is not encrypted (as defined in the statuses that apply) via email or we will inform you on the corresponding Sites as soon as possible and without reasonable delay, consistent with (i) the legitimate necessity of law or (ii) any necessary measure to determine a scope of the violation and to restore the reasonable integrity of the information in the system.
Privacy in Minors (Children)
Our Sites and Services are not directed to children under the age of 13 and we are not aware that we collect information from a child under the age of 13. If we become aware that we have collected information from a child under the age of 13, we will take the necessary steps to delete such information from our files as soon as possible.
